William Kelly's Will of 1856

*Ordered by the Court the Last Will of William Kelly be filed and entered of record.

In the name of God, Amen: I, William Kelly of the County of Hamilton and State of Illinois, being of sound mind and memory and concedering the uncertainity of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and Testament.  First: after all my lawful debts are paid and discharged, the resadue of my Estate, real and personal, I give, bequeath and dispose of as follows, (towit) To all the heirs of my Estate the sum of Two Dollars; to my dear Mother, Rachael Kelly, and my dear sister, Elisabeth Kelly, the land appertansinces, setuated hereone, known and described as

The Southeast Qr. of the Southewest
of Section Township Six (6), Town- 
ship (7) seven, Range (5)Five East,  
lying in the County of Hamilton and 
State of Illinois,                                

Together with all my personal property possessed by me during the term of their natural lifes, and after my death to be equally devided between my brothers and sisters likewise.  I make, constitute and appoint my brother, Edward Spain,  John Kelly, Jr.,; Thomas Kelly and Edward H. Spain to be executors of this my last Will and Testament, hereby revoking all former will by me made.

In Witness Wherof, I have hereunto subscribe my name and affixed my seal, the thirteenth day of August, one thousand eight hundred and fifty six.

The above writen instrument was subscribed by the said William Kelly in our presents and acknowledged by him to each of us and he at the same time published and declared the above instrument so subscribed to be his last Will and Testament, and we at the testators request and in his presents have signed our names as witness hereto and writen oposite our names our respective places of residence.

STATE OF ILLINOIS}
HAMILTON COUNTY}

This day in the County Court of Probate of Hamilton County, Illinois, on this the 15th day of June, A.D., 1857, while in Court house in McLeansboro in said County and State aforesaid, personally appeared Thomas Spain and John A. Spain of said County and State, after being duly sworn and says that the above named William Kelly, whose name is subscribed to the above named will, died on or about the 3rd day of April, 1857; that we were present and saw the said William Kelly sign said Will in their presents and acknowledge the same, and that he was in his right mind and memory as we belive and requested that we should witness the same.

In Witness our hands and seals this 15th day of June, A. D. 1857.
