Last will and testament of James Sanderfer

In the name of God amen.  I James Sanderfer of the State of Kentucky and County of Green being weak and sick, in body but of sound mind and memory, but calling to mind the mortality of my body, do make and constitute this as my last will and testament, and first I recommend my soul to God who gave it and my body to the earth to be buried in a decent Christian manner at the discretion of my friends and as to my worldly possessions, I give and dispose of them in the following manner, to wit:

Item 1st.  It is my desire that all my just debts (be) paid

Item 2nd.  It is my desire that my three ....(sons) to wit James, John and Alex when they arrive at the age of 19 years each have a horse beast worth $35.00

Item 3rd.  It is my desire that my beloved w..(wife) Elizabeth Sanderfer enjoy the whole of my Estate both real and personal (except so much thereof as shall be sufficient to pay my just debts and the three horse beasts given in the 2nd Item to my three sons James, John, Ellick (sic) which she is to enjoy during her natural life or widowhood.

Item 4th.  Should my beloved wife Elizabeth Sandefer (sic) marry It is my desire that she retain and enjoy one third and one third only of my estate both real and personal after the debts expenses and the three horse beasts named in the 2nd Item are deducted.

Item 5th.  It is my desire that the whole of my personal estate at the death of my wife, or two thirds thereof at her marriage (in case she should marry) except what is sufficient in either case to pay the debts and the three horses mentioned in the 2nd Item be equally divided among my children, Jane, Sally, James, John Betsy and Ellick (sic) or so much thereof as shall not by my said wife have been necessarily made use of previous to her death or marriage.

Item 6th.  At the death of my beloved wife it is my desire that my tract of land the whole of it, or at her marriage (should that event take place) two thirds thereof be equally divided among or between my children, William Saml (sic), Jane, Sally, James, John, Betsy & Ellick.

Item 7th.  I do hereby nominate my friends Mathew Kelly and James Durham the sole Executors of this my last will and Testament.  Witness my hand and seal this 2nd day of August 1816.

*At a County Court held for Green County at the Courthouse in Greensburg this 28th day of October 1816...The Last will and Testament of James Sanderfer deceased was produced into Court by the executors therein named and proven by the oaths of Horatio Chandler and Thomas Shipp to be the act and Deed of the said James Sanderfur (sic) and that the time of Executing the same they believe him to be in his perfect mind and memory and the same with this certificate...truly recorded in my office.  Test.
